Here is something I stumbled across regarding nighttime operations at WOAP and a modification to the WTIC license, which was GRANTED when the Waverly CP was.

I have to wonder... the station has since changed ownership and wants to remain committed to serving the original COL (Owosso) and has no interest in changing the COL to Waverly, could the argument be made to keep the WTIC license modification to allow some kind of nighttime operations from the Owosso tower with maybe a couple hundred watts? WOAP and their FM was sold to Cumulus in 1998, and the AM was divested due to ownership limits. The FM was moved from the AM tower several miles closer to Flint and now pretty much programs for the Flint market. Thus, WOAP is the only local radio station serving Owosso. It would be nice to get some kind of nighttime service.

I could be wrong, but I don't see anything there that supports your case. Nothing in that R&O applies to the current facility.

6 watts ND is the nighttime limit for WOAP before it gets into the WTIC 0.5 mv/m 50% skywave, which with a 8.46 mv/m night limit would get them about a mile and a half of night service, barely making it to the northern part of Owasso. The decision regarding WTIC revolved around whether their extended ND operation was to be protected past sunset rather than the authorized night pattern. The FCC said no, it does not, but the WTIC nighttime pattern still gets full protection.

The interference reduction agreement was between WOAP and WCAR. CBS stuck their nose in later. If WOAP does not follow through with the CP then WCAR cannot license theirs either since it is contingent. I don't know what the contractual basis was for this arrangement but there may be legal repercussions if WOAP stays put.

WOAP and WCAR are both co-owned by the new owner. I don't think he'd sue himself, but you never know. From what I've heard, he has no plans to modify WCAR either as he'd lose inner city Detroit.
